Procedure for Registration of Trademark/Logo
Trademark Registration in Pakistan involves a six-step procedure, the details of which are highlighted below:
- Determine the Classification: Determining the classification (class) that your company’s products and services fall into is the first step. You must submit a separate application for each class in which you want to register your trademark, so please keep that in mind.
- Filing the Trademark Search Application: Once the classification has been established, you must submit a Trademark Search (TM-55) application to the Pakistani Intellectual Property Office in order to find out if any identical trademark(s) currently exist on the market.
- Filing the Trademark Registration Application: Following receipt of the results of your trademark search, you must submit a Trademark Registration Application (TM-1) for each class in which you wish to register your trademark. Remember that you must submit a separate application for each class
- Response to any Objection Raised by IPO Pakistan: The IPO Pakistan will refuse to accept your application if your trademark:
- Contains obscene content
- Contains a religious symbol
- Has already been registered
- Advertising in the Trademark Journal: The IPO Pakistan will issue notices to publish your trademark in the Trademark Journal once it is completely satisfied that it has no similarity to an existing registered trademark or a pending registration. The purpose of this is to guarantee that there are no registered trademarks with a similar design by giving the public a chance to voice any concerns.
- Final Registration: The IPO Pakistan will send out additional demand notices for the filing of Form TM – 11 for each class in which the trademark application was submitted if there are no public objections after your mark is advertised in the Trademark Journal. By doing so, the trademark registration is confirmed, and a certificate of registration is issued.
